TERMS OF SALES
Definitions
Site: This commercial site accessible at the address www.antiquites-chaumont-bordeaux.com which aims to sell online, to individuals, collection items, furniture, lighting, tableware, religious objects, ceramic.
User: Any Internet user, adult natural or legal person, connected to the Site Client: The User who has created an account on the ANTIQUITES CHAUMONT Site.
Personal Data or Data means the information that the User voluntarily provides when opening an Account on the Site and/or that which will be collected in connection with access and/or use of the Site.
Order validation: The firm and definitive confirmation of the details of the order by the Customer, which presupposes the acceptance of the General Conditions of Sale.
Object
These general terms and conditions of sale govern the contractual relationship between ANTIQUITES CHAUMONT and the Customer and are applicable to all orders made through the Site.
Opposition of the general conditions of sale
The Customer declares to have read and understood these general conditions of sale.
The sale of products offered by ANTIQUITES CHAUMONT is subject to these general terms and conditions. The fact of placing an order on the Site implies the Customer's full and unreserved acceptance of these general conditions of sale.
In this regard, the Customer has the option of downloading, saving and reproducing the general conditions.
The contract of sale of a good purchased on the Site consists of the general conditions of sale in force at the time of the order and the order form.
The Customer acknowledges being fully informed of the fact that his agreement concerning the content of these general conditions of sale does not require the handwritten signature of this document, but results from his sole placing of an order.
The acceptance of these general conditions is made in the form of a positive double click following the reading of these general conditions of sale and constitutes proof that the Customer has read the said provisions and will be worth irrevocable acceptance of these.
These general conditions of sale shall prevail over any other general or specific condition not expressly approved by ANTIQUITES CHAUMONT. The fact that ANTIQUITES CHAUMONT does not take advantage at any time of any provision of these general terms and conditions of sale cannot be interpreted as a waiver of the right to take advantage of this provision at a later date. ANTIQUES CHAUMONT reserves the right to modify its general conditions of sale at any time. In this case, the modifications will be applicable to the sales contracted as soon as the modified general conditions of sale are posted on the Site.
Capacity
The purchase of products marketed by ANTIQUITES CHAUMONT does not fall under one of the acts of management of daily life, within the meaning of the provisions of article 1146 of the civil code. Consequently, the Customer declares to have the capacity to contract under the conditions described below, that is to say to be an emancipated minor or to be of legal majority and not to be protected within the meaning of article 488 of the Civil Code.
Products offered for sale online
The products offered for sale online are those presented on the Site. The products are described using descriptive sheets and photos by ANTIQUITES CHAUMONT on the Site with the greatest possible accuracy. ANTIQUES CHAUMONT nevertheless informs the Customer that despite all the attention it has shown, the descriptions and photos cannot ensure perfect similarity with the product offered for sale, particularly as regards the colours. The differences may result from the color quality of the photographs, the difficulty of displaying the rendering of the materials on the screen or, without however being exhaustive, the technical adaptation. These differences can in no way be interpreted as lack of conformity, lead to the cancellation of the sale and engage the responsibility of ANTIQUITES CHAUMONT.
Any order implies express and irrevocable acceptance of the description of the products.
The Customer must ensure before any order that the ordered product can be transported without difficulty to his home, in particular because of its weight and volume. The Customer must in particular ensure that the product can pass through the doors and use any corridors. Window delivery is not guaranteed.
The impossibility of delivering the ordered product due to access conditions to the Customer's home will not engage the responsibility of ANTIQUITES CHAUMONT.
The product offers and prices appearing on the Site are valid as long as they appear on the Site, within the limits of available stocks. In case of unavailability of a product, ANTIQUITES CHAUMONT informs the Customer as soon as possible by e-mail or telephone. The Customer may confirm his order by accepting an extended delivery period or request reimbursement of the product on the basis of the price invoiced.
The unavailability of products will not engage the responsibility of ANTIQUITES CHAUMONT.
Prices
The prices of the products offered for sale on the Site are expressed in euros, and are valid only on the Site. These prices do not include delivery and package preparation costs, which will be indicated before the final validation of each order. The prices of the products may be modified at any time by ANTIQUITES CHAUMONT and without prior notice to the Customer. The products will be invoiced on the basis of the rates in force at the time of the registration of the order.
Any order implies express and irrevocable acceptance of the prices of the products.
For international markets, the prices of the products are indicated in euros, the prices are indicated excluding tax at check-out. These orders are subject to any taxes and customs fees in the country of destination. Customs charges must be paid by the Customer directly to the carrier.
Ordered
Before making a purchase on the Site, the Customer may first register on the Site. For this purpose, he can have a personal account. All stages of the sale are clearly identified on the Site in accordance with the provisions of article 1125 of the Civil Code.
The contracting procedure includes the following steps:
Step 1: selection and validation of the products, the Customer can at this stage modify his order and correct it;
Step 2: referencing the mandatory fields of the identification and information forms;
Step 3: consultation of the general conditions of sale;
Step 4: acceptance of all the general conditions of sale;
Step 5: placing the order by clicking on the "order with payment obligation" tab
In application of this process, the Customer has the possibility to check the details of his order and its total price, and to correct any errors before definitively validating his order.
The order is only definitively recorded after validation by the Customer of his payment agreement and acceptance by the bank of the transaction. The summary of the Customer's order is available in printable version.
As soon as his order is registered, the Customer receives a confirmation email containing the essential elements of his order and in particular the order number, the list of products ordered, the price details.
All the data provided by the Customer during the ordering process and the recorded confirmation of this order constitute proof of the transaction. ANTIQUES CHAUMONT reserves the right to refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order as long as this dispute is not resolved.
Payment
The means of payment on the Site is the bank card and exclusively the following cards: classic Blue Card, VISA card, MASTERCARD card, American Express card, Apple pay and PayPal.
Payment Security
For maximum security, ANTIQUITES CHAUMONT works in collaboration with the STRIPE application which makes it possible to secure all the payment phases to be carried out between the buyer and the bank. The steps are fully encrypted and protected. The protocol used is SSL coupled with electronic banking. This means that the information related to the order and the bank card number do not circulate unencrypted on the Internet. STRIPE does not keep the card numbers after having transmitted the payment transaction to the bank of ANTIQUITES CHAUMONT.
Invoice
Each invoice is available on the site in the customer account via "my orders" and in the order confirmation email.
Delivery
The delivery area is Europe plus international. The products will be sent to the delivery address that the Customer indicated during his Order. Delivery costs are calculated according to the weight / volume of the package and the destination country. The delivery of the order is ensured mainly by LA POSTE Colissimo and UPS, also for international. The order is delivered from Monday to Saturday between 8 a.m. and 3 p.m. directly to the address indicated. In the event of absence or impossibility of delivery of your package, the delivery person will leave a delivery notice mentioning the date and address of the drop-off point where you can collect your package on presentation of an identity document.
From the date mentioned on the delivery notice, you have 15 days to collect your package. After this time, it will be automatically returned to its sender. At any time, thanks to the parcel number sent to you by email, you can track your parcel by connecting to the parcelsapp site to find out where it is.
When the order is dispatched, the Customer will be informed of its dispatch by email. ANTIQUES CHAUMONT is committed to a delivery time of less than 15 days.
However, this period being indicative, it could be extended up to a maximum of 30 days. Beyond 30 days, the Customer may, by registered letter with acknowledgment of receipt, request the termination of the sales contract or grant an additional period to ANTIQUITES CHAUMONT.
In the event of termination of the sales contract, ANTIQUITES CHAUMONT is required to reimburse the Customer within a maximum period of 14 days from receipt of the request for termination of the contract. Any delay in delivery must be indicated to ANTIQUITES CHAUMONT within 21 working days after dispatch, to allow the carrier to carry out a reliable investigation.
For international, customs fees must be paid by the Customer directly to the carrier.
Some bulky products cannot be shipped internationally and to certain coastal islands.
Given the volume and dimensions of certain products, it is the Customer's responsibility to ensure prior to delivery that the conditions of access to the delivery address are compatible; failing this, the Customer will assume the burden either of the implementation by the carrier of additional means, or of the reiteration of the delivery operation.
Upon delivery, the Customer will carry out a physical inspection of the Product in order to determine whether the Product is affected by transport damage and/or whether it complies with the specifications of the order; in the 1st case, the Customer must report the damage on the delivery note and/or within 48 hours by registered letter with acknowledgment of receipt to the carrier's address; in the second case, the lack of conformity of the Product in relation to the order must be notified under the same conditions to ANTIQUITES CHAUMONT; failing to respect this deadline, no complaint will be accepted. The delivery time is an indicative time. Consequently, exceeding the indicative delivery date appearing on the order cannot give rise to damages, withholding, or cancellation of the order in progress.
Withdrawal
In the event that the item(s) ordered do not give satisfaction, the Customer has a legal period of fourteen (14) clear days from the day of receipt of the package to return it, in accordance with article L 121- 20-12 of the Consumer Code, it being specified that when the period of fourteen (14) days expires on a Saturday, a Sunday or a holiday or non-working day, it is extended until the first following working day.

The product must be returned in its original packaging and carton and in perfect condition. Dirty, bent, damaged, scratched, stained or washed products will not be taken back by ANTIQUITES CHAUMONT. In this case, the package will be returned to the Customer and the costs of returning the product are the responsibility of the Customer.
The document “Declaration en Douane / CN23” present in the transparent pouch must appear on the outside of your package with the mention “Sale of goods” crossed out and the box “Return of goods” checked. The invoices initially present on the outside of your package must also be present.
From the exercise of your right of withdrawal, you have fourteen (14) days to return the purchased Product.
In the event of a return accepted by ANTIQUITES CHAUMONT, you will be reimbursed, at most within one month from the day when ANTIQUITES CHAUMONT receives the item and validates its conformity, in accordance with the provisions of Article L. 121- 21-4 of the Consumer Code.
Transfer of ownership / transfer of risk
The transfer of ownership of the products to the benefit of the Customer will only be carried out after full payment of the price by the latter, and this regardless of the date of delivery of the said products. However, the transfer of the risks of loss and deterioration of the products will be carried out for the benefit of the Customer upon receipt of the products by the Customer, to whom it belongs, in the event of damage or loss (for example: damaged package, already opened. ..), to make any reservations and to exercise any recourse with the postal services or other service providers.
Responsibility
ANTIQUITES CHAUMONT cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses.
ANTIQUES CHAUMONT disclaims all responsibility for the content of sites to which hypertext links may refer from its own Site.
Furthermore, ANTIQUITES CHAUMONT is exonerated from any liability for any breach of its contractual obligations in the event of force majeure or a fortuitous event. Force majeure is any event, occurring independently of ANTIQUITES CHAUMONT and the Customer, which has the effect of partially or totally preventing the performance of contractual obligations. Are considered as cases of force majeure or fortuitous events, in addition to those usually retained by case law, total or partial strikes, lockouts, epidemics, earthquakes, fires, storms, floods, water damage, blockage of means of transport or procurement, governmental or legal restrictions, blocking of electronic communications.
In the event of force majeure or fortuitous event, ANTIQUITES CHAUMONT undertakes to inform the Customer within seven (7) days of its occurrence. If this impediment continues beyond a period of fifteen (15) days, the Customer may request the termination of his order.
Intellectual property
All elements of the Site are and remain the exclusive intellectual property of ANTIQUITES CHAUMONT. The Customer is not authorized to reproduce, exploit, distribute, or use for any reason whatsoever, even partially, elements of the Site, whether software, visual or sound. The texts and images as well as the graphic charter of this Site are protected by intellectual property law. It is forbidden to copy, extract, distribute, modify or adapt the content of the Site. The downloading as well as the printing of text, images and graphic elements are authorized for private and non-commercial use only. The reproduction of images and texts in other electronic or printed publications requires the prior written consent of ANTIQUES CHAUMONT.
Protection of personal data and registration
Simply consulting the Site does not require registration or identification with ANTIQUITES CHAUMONT.
However, any order may require prior registration and the creation of a personal account subject to the Customer's unreserved acceptance of the Privacy and Cookies Policy.
The user undertakes, during the registration procedure, to provide complete and truthful data.
The creation of the personal account will lead to the recording and computer processing of personal data, including IP addresses, which will be communicated to ANTIQUITES CHAUMONT.
This recording and this computer processing are intended to allow the taking and processing of the order, and to ensure delivery to the Customer.
The data is exclusively intended for the use of ANTIQUITES CHAUMONT but may also be communicated to its partners when the Customer has expressly accepted their disclosure by ticking the corresponding box when ordering. Under no circumstances will this data be commercially transferred to third parties.
The information collected by ANTIQUITES CHAUMONT during a Customer order is necessary for the management of the transaction and, for this purpose, may be communicated in whole or in part to the service providers of ANTIQUITES CHAUMONT involved in the execution of the order. .
In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 applicable from May 25, 2018, the Customer has at any time a right of access, rectification, modification, limitation, deletion and finally the right to the portability of personal data concerning him by contacting ANTIQUITES CHAUMONT responsible for this processing:

Disputes
These general conditions of online sale are subject to French law. All disputes that cannot be settled amicably are the exclusive jurisdiction of the courts of BORDEAUX, notwithstanding multiple defendants or warranty claims, unless otherwise provided by public order.
Once your order has been validated, it cannot be cancelled.
It will not be possible to modify your order once it has been placed, you will have to re-order. The return will be the responsibility of the customer, no exchange will be accepted. Returns are accepted within 14 days.
